Subsp nutans is a duplicate name species name (on CNM), although you're technically correct. Hopefully, it'll be sorted out once the new taxonomy system is fully up and running :).
I suppose we should be thankful that only one subspecies arrived in Australia. It is listed as Carduus nutans in ACT Pest Plants declaration but subspecies nutans in NSW.
